These Terms and Conditions govern your access to and use of halsworthhayes.shop (the “Website”) and any purchase you make from Halsworth & Hayes. Please read them carefully before placing an order. By placing an order, registering an account or otherwise using the Website, you confirm that you accept these Terms.

We reserve the right to refuse or cancel any order where we reasonably believe these conditions are not satisfied or where we suspect fraud, misuse or breach of these Terms.

3. Account creation

You may purchase as a guest or register a customer account. If you create an account, you are responsible for:

  • keeping your login details confidential;

  • all activity that takes place under your account.

Please notify us promptly if you suspect unauthorised access or misuse of your account. We may suspend or terminate accounts where we reasonably believe there has been a breach of these Terms.

4. Product information

We take reasonable care to describe the Goods accurately, including where applicable composition, key features and care instructions. Photographs are intended to give a fair impression of the Goods, but colour may vary depending on your screen, calibration and ambient lighting.

Minor variations in natural fibres, texture or finish do not necessarily mean that an item is faulty. If a product is materially different from its description, your statutory rights may apply.

5. Prices and payment

All prices are shown in pounds sterling (GBP). Delivery charges, where applicable, are shown at checkout before payment. The payment methods available are displayed at checkout.

We take reasonable care to ensure that prices are correct. If we discover a pricing error that is obvious and material, we may cancel the order, even after dispatch confirmation, and refund any amount paid in full. Customers will be notified of any such cancellation and refund.

6. Order process

Your order is an offer to buy the Goods. When you place an order, we send an acknowledgement email confirming that we have received it. That email is not acceptance of your order.

The contract between you and us (“Contract”) is formed when we send a dispatch confirmation email confirming that the Goods have been shipped.

We may reject an order, or part of an order, for reasons including:

  • the Goods are out of stock;

  • payment is not authorised;

  • we suspect fraud or misuse;

  • delivery is not feasible to your address.

Any amounts paid in respect of a rejected or cancelled order will be refunded in full using the original payment method where possible.

7. Delivery, risk and title

Estimated delivery times and available shipping options are set out on our Shipping & Delivery page and at checkout.

Risk in the Goods passes to you on delivery to the address you supplied, or to a person you have identified to receive the Goods. Legal title in the Goods passes to you when we have received payment in full.

8. Cancellation rights – statutory right to cancel

If you are a consumer, you have the right to cancel most online orders within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right, you must:

  • clearly inform us of your decision to cancel before the 14‑day period expires; and

  • return the Goods within 14 days of notifying us, in accordance with our instructions.

We will refund the price of the Goods and the standard outbound delivery cost within the time required by law. Any enhanced or express delivery costs are non‑refundable unless required by law.

This statutory right does not apply to items that are excluded by law, including bespoke or personalised items and certain hygiene‑sensitive goods, where applicable.

10. Consumer rights and statutory guarantees

Nothing in these Terms affects your statutory rights as a consumer. Goods must be of satisfactory quality, fit for purpose and as described.

If Goods are faulty, damaged or not as described, you may have rights under the Consumer Rights Act 2015, which may include repair, replacement, price reduction or refund depending on the circumstances and timing of the issue.

11. Chargebacks and disputes

If you have any issue with your order, you are encouraged to contact us first. Most problems can be resolved quickly through our customer‑care team.

We may challenge chargebacks that we reasonably believe are unjustified or fraudulent, and provide relevant evidence to our payment processors where necessary. You agree to cooperate in good faith in the resolution of any dispute relating to your order.

12. Intellectual property

The Website and its content, including text, photography, layout, design, logos and branding, are owned by or licensed to us and are protected by intellectual property laws.

You may not copy, scrape, mirror, frame, reverse‑engineer or otherwise misuse our Website or its content. You may access the Website and print or download extracts for your own personal, non‑commercial use only.

If you submit user content, such as a review or photograph, you grant us a non‑exclusive, royalty‑free licence to use that content in connection with the Website and our marketing, subject to applicable law and your statutory rights.

We are not responsible for delays or failures to perform caused by events beyond our reasonable control, including without limitation:

  • severe weather or natural disasters;

  • strikes, labour disputes or industrial action;

  • supply‑chain disruption or transport failures;

  • power outages, internet failure or cyber‑attacks;

  • fire, flood or other emergency;

  • government action, regulation or restrictions.

If such an event occurs, we will take reasonable steps to minimise its impact where we can.

18. Suspension and termination

  • we are required to do so by law or by a competent authority.

Any rights and obligations that have already accrued (for example your payment obligations and our warranty obligations) will continue to apply.

20. Governing law and jurisdiction

These Terms and any Contract between you and us are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over any dispute, subject to any non‑waivable consumer‑protection rights that may apply in your country of residence.
